Terms & Conditions

The Contract

The following booking terms & conditions form the basis of your contract with Scuba Nation Diving Centre herein after called the Company. Your contract will be with the Company. Your contract with the Company is made once the specified deposit/credit card details have been supplied and the Company has signified, in writing, its acceptance of the booking and you have been sent written confirmation by email from the Company.

These terms and conditions and the booking form will form the entire terms of the contract between the Company and the person making the booking (the lead client), who will be deemed to agree to the booking for and on behalf of all other persons named on it. The agreement to the booking by the lead client will constitute acceptance of these conditions by all the clients and the parties named on it and as confirmation that the lead client has authority to act on behalf of all other persons named on the form. If you have any special requests outside the services offered the Company will endeavour to assist but is not obliged to do so. These must be notified to the company in writing before booking. After booking they will be treated as an alteration and a charge may be made. Any additional costs of a special request must be borne by you.

Reservation and Payment

  1. The specified deposit/credit details guaranteeing deposit are due on booking. (currently 50%)
  2. The balance of the trip/course cost as set out on the Company’s booking form must be guaranteed not later than 14 days prior to the date of departure. Failure to do so will result in the booking being treated as cancelled by you. Cancellation charges will be payable as set out below.
  3. In the case of bookings made less than 14 days before the departure date, payment must be guaranteed in full upon booking.
  4. The company reserves the right to alter published rates without prior notice. National Park and Port fees are subject to increase and/or amendment by government policy and are out of the control of the company.

Cancellations of Internet Bookings

If you wish to cancel your trip/course, written notification must be given to the Company by the Lead Client. The date of cancellation will be the date the Company receives this written notice. In the event of cancellation by you, the following cancellation charges will be payable: 1. 30 days or more prior to start date: deposit refunded less any incurred charges 2. 30 to 14 days prior to start date: Deposit lost 3. Less than 14 days prior to start date: No refund 4. Due to the limited number of spaces on our professional level courses we are unable to offer any refunds if cancelled less than two months prior to the start date.

If the trip/course is cancelled by the company for whatever reason then an alternative day will be provided, if this cannot be done due to travel restrictions then a full refund will be made minus any course material already supplied. The company reserves the right to change the trip destination to a suitable alternative if conditions require this. If the trip/course is not cancelled but the client chooses to not complete it, the company is not responsible for any refund.

Lastly, The Company does not offer refunds in the event of personal injury, airplane delay, mechanical breakdowns, weather, sickness, strikes, war, criminal acts, quarantine, acts of god, if another guest requires immediate evacuation and the vessel must return to port or any other event beyond its actual control. Guests are strongly advised to have valid dive medical, travel and cancellation insurances.

Alterations by you

It is vitally important that your requirements be clearly stated at the time of booking. If, once the booking has been accepted by the Company, you wish to make any alterations to the booking details, e.g. change date, duration etc., the company will do all it can to assist you although it is under no obligation to make any alterations. The Lead Client must send a written alteration request to the Company at least 14 days prior to departure. You will be required to pay any additional costs arising from your alteration. However, any alterations made by you less than 14 days prior to departure may be treated at the company’s discretion as a cancellation.

Any changes you wish to make to your holiday arrangements once your holiday has commenced are your sole responsibility. The Company will not be responsible for the additional cost of any changes you make whilst on holiday and these must be paid for by you.

Insurance

It is your responsibility to ensure that you have adequate insurance cover. It is a condition of booking your holiday that you have taken out adequate insurance against such risks as medical costs, personal accident risks, personal liability and legal expenses. You are especially advised to insure against cancellation and loss of deposit. You are required to ensure that your policy has an endorsement for scuba diving if you are undertaking it as part of your tour.

The Company do not accept any legal liability for loss or damage to any luggage, electronics or dive equipment while being transferred to/from the vessel nor while on board. The Company will offer any assistance possible to help with any insurance claims for lost or damaged property. Clients are advised that certain diving sites are very remote, either by distance or time or both, from a recompression chamber.

Unused Services

No refund or compensation is payable by the company for any unused accommodation diving, services or features provided during the holiday. Clients who do not complete a diving course for any reason whatsoever, cannot be refunded for a portion or the remainder of the diving course.

Force Majeure

The Company accepts no responsibility for and shall not be liable in respect of any loss or damage or alterations, delays or changes arising from unusual and unforeseeable circumstances beyond its control, such as war, or threat of war, riot, civil strife, industrial disputes including air traffic control disputes, terrorist activity, political unrest, change in government regulations, natural and nuclear disaster, floods, fire and adverse weather conditions, technical problems with transport, closure or congestion of airports or ports.

Day and Liveaboard trips

All trips include equipment; PADI certified Divemaster; all meals - breakfast, lunch (and dinner on the liveaboards); snacks, fruit and soft drinks all day; and transport from the Sihanoukville Dive Centre to the boat and back again.

Diving

Proof of diving qualification by a recognised agency is compulsory. Clients must submit their diving qualifications to the Divemaster before diving can commence. All clients on the booking form participating in scuba diving must be in good health and not have any medical history of lung disorders, asthma, epilepsy, diabetic or recent surgery and agree to discontinue diving if respiratory congestion or a head cold or any other medical condition takes place during the holiday. If the client has any medical condition contrary to these requirements and/or requirements listed on the PADI Medical form he/she must produce a diving medical certificate of fitness, prior to diving. Failure to provide satisfactory diving qualifications or medical certificates will not result in any liability whatsoever on the part of the Company.

The Company makes every effort to ensure the highest standards of diving etiquette and safety. However, clients are advised that diving takes place at their own risk and they must behave in a fit and proper manner at all times, in accordance with all recognised diving practices and procedures and take proper responsibility for their own safety. Clients are advised that certain diving sites are very remote, either by distance or time or both, from a recompression chamber.

The Company reserves the right to require to withdraw from the holiday any person whose actions or conduct is considered by the Company in its absolute discretion to be incompatible with the comfort and safety of the company’s other clients or to be offensive to them. In the event of such conduct, no liability whatsoever will be owed to that person by the Company upon withdrawal from the holiday.

Government Policy

The company reserves the right to alter published rates without prior notice. National Park, Port and visa fees are subject to increase and/or due to amendment by government policy change, and are out of the control of the company.

Travel Documents

It is your responsibility to ensure that all necessary travel documents such as passports, visas and diving qualifications are obtained and are valid. No refund will be made due to Travel Documentation not being in order.

Complaints

If you have cause for complaint whilst on holiday, you must bring it to the attention of the Company who will then do their best to rectify the situation. It is unreasonable to afford the Company or its representatives no opportunity to rectify any problem whilst on your tour and failure to do so on your part may affect your right to compensation. Should any problem remain unresolved, any complaint must be made in writing to the Company within 28 days of completion of the tour.

General Cancellations

At Scuba Nation we endeavour to provide you with quality dive services. To maximize personal attention we keep to small groups of divers and students. As a result of this we have the following cancellation policy:

Courses

If you fail to attend or if you appear after the scheduled start time of your course for any reason it is at the Company’s discretion if your course can be rescheduled dependent on the bookings we have. If we can reschedule, there may be a charge equivalent to that day of the course missed, plus retail price for any manuals. If in our opinion we cannot reschedule the course this will be treated as a cancellation and there is no refund and the course is charged in full. If you have a liveaboard included as part of your course and we reschedule on day trips rather than a liveaboard there is no refund. If the course is not completed within 6 months of signing up, it is considered a cancellation and there is no refund.

All students must fill out the required PADI medical form and if any of the conditions specified in the Medical Questionaire apply to you, you must get a dive medical signed by a doctor and bring it with you. If the failure to provide satisfactory diving qualifications or medical certificates results in a delay starting the course there may be a charge equivalent to that day of the course missed, plus retail price for any manuals. If it results in a cancellation of the course, there is no refund and the course is charged in full.

Day Trips

If you show up later than the agreed time you will need to make your own arrangements to meet the dive boat. Please understand that in the interest of other customers, we cannot delay the boat departure time. The cost of your missed trip cannot be refunded. You are responsible for any costs incurred. All bookings carry a 50% cancellation fee and if you cancel within 14 days of the start time of your trip you will pay a 100% cancellation fee.

No show NO REFUND

Liveaboard Trips

Due to the limited numbers that we carry on our liveaboards we are UNABLE TO OFFER REFUNDS if you cancel within 14 days of the date of the trip.

Alcohol/Drugs

We reserve the right to cancel your day trip, liveaboard or course if it is of our opinion that you are intoxicated or suffering from any effects or after-effects of alcohol or drugs. NO REFUND

All refunds for services paid with credit cards will incur a 10% service fee to cover bank charges. If Scuba Nation is responsible for you missing your course or dive trip then we will offer you alternative dates. If for whatever reason you are unable to make those dates we will refund your money in full.

We reserve to right to amend trip itineraries and dive site selection with regards to weather and safety considerations. The Company will offer any assistance possible to help with any insurance claims for missed course and/or trips.
